Accident Claims No Win No Fee

"No win no fee" in respect of an accident claim, how many times have you heard this said? We have evolved and developed into a health and safety mad society. One can rarely undertake any tasking, employment or afternoon of shark wrestling without someone stepping in to warn us about the health or safety risks. My first question to you, is why?

The truth is we now (more than ever) are better aware of our rights as an individual and how we can exercise and protect them. We know of the basic safety requirements organisations and employers are required to have in place to ensure our safety. With that we also know that if we suffer an accident or injury as a result of any failings on their part a claim is there to be had, and with a successful claim comes money.

This ‘suing and blaming’ culture started in the United States before the United Kingdom. However, as with so many products of globalisation (or Americanisation as it is sometimes mockingly referred) it has migrated over to our culture and we have adopted and embraced it here.

We now see a wealth of no win no fee adverts on television. Companies are everywhere, promising individuals who have suffered in the past an opportunity to remedy their problems by fiscal means. We are encouraged and lured into making a claim.

Unfortunately this cultural shift means employers are suffering. They have to put aside money for legal fees and protective insurance. Restrictions in so many of the manufacturing sector have resulted in reduced productivity, and therefore reduced profit.

The question I put to you reader, who is to blame? Is it the Claimant for trying to get some money from his/her employer or an organisation when they feel that the employer/organisation should have done more? Is it the Employer/organisation for allowing this to happen? Or is it simply the lawyers that encourage us to make these claims? You decide.
